Chapter 13 Bankruptcy Timeline part 2

Here is the second part of Chapter 13 Bankruptcy Timeline article. We recommend reading the first part before continuing with this one.

5. Notice of Commencement of Case
Around 15 days after you filled for bankruptcy the court will send you the Notice of Commencement of Case (this is send to all of your creditors also).This notice will contain the date set by the bankruptcy court for the meeting between you and your creditors. Also it will have the time period in which your creditors can object to your case and file the claims.

6. One month after you filed for Chapter 13
You must make your first payment approximately 30 Days After Your Chapter 13 Repayment Plan is filed. If not, your case can be dismissed.

7. Six weeks after
Six weeks after you start the bankruptcy process the court will keep the meeting between you and your creditors. The trustee will lead the meeting who is a very informal one. At this meeting you need to testify under oath as to the accuracy of the statements in your petition. In case you don’t attend the meeting the case will be dismissed.

8. Ten weeks after
After the meeting between you and you creditors took place there is a 30 days window in which the trustee or creditors can object to all of your explanations.

9. Twelve weeks after
Six weeks after your first meeting with credits the bankruptcy court will keep a hearing in which the trustee will make his recommendation to the judge. The trustee will tell the court if your repayment plan should be approved or not. Your creditors can attend the meeting but they don’t have the right to object.
